CBD oils are available in Kansas retail stores. Some of these oils the infamous THC too. CBD (cannabidiol) is a non-psychoactive compound. But the THC (tetrahydrocannabinol) is a psychoactive compound. The latter is infamous for its mind-altering effects and producing a ‘high.

CBD oil in Kansas. Question: is CBD oil legal in Kansas?
Many Americans want THC to be legalized for both its medical and recreational benefits. Kansas state laws are one of the most restrictive laws against the substance in the US.
The retailers argue that on July 1, all CBD products have become legal. They cite that the state regulation regarding cannabis-related substances has been tweaked now. Recently, a bill was passed to support Kansas’s industrial hemp program.
Some other vendors thought that the new law allows the sale of products with small amounts of THC. However, a high-level official from the Kansas Bureau of Investigation (KBI) released a statement stating:
“Full-spectrum is not legal. Only CBD isolate or CBD oils containing no other controlled substances are legal in Kansas.’
Kelly Rippel, who heads a hemp advocacy group in the state, posted the warning on the group’s Facebook page.
Full-spectrum CBD oils often include THC. But buyers need to be aware that not all full-spectrum Kansas CBD oils contain THC. Some of the oils labeled ‘THC-free’ do have traces of the substance in it.
The sources from inside the CBD industry revealed that CBD products with THC are now easily available throughout Kansas. The Kansas News Service also claimed that it could easily purchase CBD oils with THC within the state.
CBD retail leaders in Kansas were all prepared to sell full-spectrum CBD oil to the people of Kansas from July 1. But after KBI’s warning, they postponed the plan. Many of them say that they have become accustomed to the changing nature of state-by-state CBD regulations. They have still not received the letter of intent from the legislators. Most of them hope that the full-spec CBD oil will not remain ‘illegal’ for long.
A KBI spokesperson told the media that the issue is under review at present.
Senator Mary Ware own two CBD stores in Wichita. She claims that the new Kansas law legalizes full-spectrum CBD oils. A revisor and an attorney from the Department of Agriculture assured her about it. But the Department of Agriculture’s spokesperson denied it. She said that the agency doesn’t directly regulate CBD oils. The department does not regulate:

All the hemp-based products are required to meet the legal requirements already in place.
On a side note, the Kansas law bans THC in CBD. Kansas legalized CBD in 2018 but they could only sell cannabidiol products that did not have THC at all.
Both the cannabidiol and the tetrahydrocannabinol come from the cannabis plant. High-THC varieties yield products that produce a ‘high’. Low-THC varieties of the plant are called ‘hemp’. Industrial hemp has less than 0.3% THC. The products derived from industrial hemp are believed to be ‘legal’ now – under federal law.
For now, Kansas state authorities are avoiding the question on the legal status of the full-spectrum CBD products.
Kansas lawmakers have passed two laws regarding cannabis and its extracts recently:
Vendors believe that the bill allows the sale of full-spectrum CBD in Kansas which can contain some THC. Kansas Governor Laura Kelly signed the Senate Substitute for House Bill 2167. The Bill establishes the Commercial Industrial Hemp Program. Kansas will now monitor and regulate the commercial production of hemp in the state.
The bill prohibits the production and marketing of specific hemp products though. It allows the growth of ‘industrial hemp’ only which contains less than o.3% THC by dry weight.
Earlier, the 2014 Farm Bill allowed one to grow industrial hemp only for research purposes.
This bill might help people facing prosecution for illegal CBD possession n the state.
This law came into effect on July 1, 2019. It allows profoundly ill people to obtain low-THC CBD oil in Kansas. The cannabidiol oils used for medical purposes cannot have more than 5% THC.
Gwen and Scott Hartley pushed this law for their daughter Lola. Lola is 12 years old and suffers from microcephaly. Microcephaly is a medical condition in which a child’s brain does not develop normally. Lola’s head is abnormally small for her age. Hartley’s older daughter – Claire – died from the same disease in December 2018. She was 17 years old.
Hartleys said that the CBD oil helps their daughter with her seizures.
According to House Bill 2244, patients need to have a doctor’s letter 15 months before they purchase it. The letter should state that the patient has a life-threatening medical condition.
The law also requires the third-party lab test results to ascertain the quality of the oil.
Senator Ware claims:
“It will take more than a gallon of CBD oil with 0.3% THC to get you ‘high’. It means that you will probably fall sick before you get ‘high’.”
A CBD and medical cannabis researcher, Mallory Loflin, does not agree. She says,
“A bottle of CBD oil can get a novice user high. But it is true that the fatty oil in the bottle may also cause diarrhea.”
CBD is not psychoactive in itself. It does not have the buzzy effects people associate with marijuana. Some of the CBD’s health benefits include:

Its use may interact with some medications. Using CBD oil can also increase the levels of some liver enzymes. American Academy of Pediatrics cautions pregnant women and nursing mothers against ingesting CBD.
Generally, CBD oil is safe to use. But if you have specific health conditions, you should talk to the doctor first.
CBD also counters the effects of THC. So, if you need THC for medical purposes, you may have to take 100 mg of THC (without the CBD) to feel the buzz. Novice users may get ‘high’ on as little as 5 or 10 mg of THC. The amount of THC that can get you high depends on the tolerance level of a person.
On average, 20 mg THC can produce a ‘mild high’ effect on a non-regular cannabis or marijuana user. Regular smokers may need 50 mg to 500 mg of THC to feel the ‘high’. CBD oils with 0.3% THC do not have intoxicating effects. They are safe to use.
Ceally Smith’s has a 6-year-old autistic son – Bodhi. Bodhi has a sensory disorder. He was having problems with school because he was uncontrollable. Ceally claims that half a dropper of CBD oil under the tongue twice a day did wonders for her kid. He started socializing with kids and is now doing amazing at school.
Smith also said that the CBD oil also helped her daughter with anxiety issues.
Dr. Stephen Thornton is a part of the University of Kansas Health System. He says that while the FDA approves of CBD for epileptic patients. But, there is little scientific evidence to suggest that it works for other medical conditions. He also believes that CBD oil is non-toxic.
Dr. Thornton warns that CBD oils can be dangerous for those with allergies. Many manufacturers mix in yeast or hard metals in their CBD oils which can be harmful to some users. Hence, it is imperative to research a CBD product before you buy it.
What is the legal status of CBD oil in Kansas. But the legality of CBD oils with THC is still unclear. Many retail stores and pharmacists are selling CBD oils (with or without THC) across Kansas. However, some premium CBD oils are still not available in local stores in Kansas due to legality issues.

The Food and Drug Administration (FDA) has extended the public comment period on CBD oil by two weeks. Its last deadline to share input was July 16, 2019. The research on cannabidiol and its health benefits is still in the nascent stage. Hence, the FDA is seeking data to ensure that the CBD products are safe to use by the public.
